These terms and conditions represent an official agreement "contract" between Al Bassami International Business Group, the advanced owner of the trademark "Al Bassami International Business Group Application" and the users of the application (customers and service providers). These user terms govern your use of the Al Bassami International Business Group Application, which is an electronic platform that brings together flatbed service providers and customers using the application, as the Al Bassami International Business Group Application allows flatbed service providers to contact customers using the application and provide them with services subject to what the application allows.

Any use by you of the services provided by the Al Bassami International Business Group Application constitutes your acceptance of this contract and its provisions, and accordingly you must not use the application if you do not agree to the terms and conditions contained in this contract.

Al Bassami International Business Company application reserves the right to amend or change these terms and conditions without prior notice, and it is your responsibility as a user of the application to review the controls and terms of use periodically to know the updates to these terms and conditions, through the terms and conditions in the application. Eligibility to Obtain Services

You acknowledge and warrant the following:

• That you have full power and authority to contract and that you will not be in violation of any law or contract.

Commitments and Warranties

You acknowledge and warrant that:

• You will comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.
• You will provide accurate and correct information to the Bassami International Business Company application and update it periodically.
• You will review and comply with any notices sent through the Bassami International Business Company application regarding your use of the service provided by the Bassami International Business Company application.
• You will not duplicate, sublicense, issue, publish, transfer, distribute, perform, display, sell, or reclassify the services of the Bassami International Business Company application, or you will have transferred or commercially exploited the service, except as permitted under this agreement.
• You will not use the information, content or any data you access or obtain through the Bassami International Business Company application services for any purpose other than for personal use and you will use the application and the service exclusively for your own purposes and will not sell it to any third party (including but not limited to providing any service to anyone else).
• You will use the service or application for lawful purposes only, and you will not use the services to send or store any illegal or fraudulent material.
• You will not use the Service or the Application to cause harm, harassment or inconvenience to anyone.
• You will not obstruct the proper operation of the Al Bassami International Business Company Application.
• You will not attempt to harm the Service or the Application in any way.
• You will not copy or distribute the Application or other contents without obtaining written permission from the Al Bassami International Business Company Application.
• You will keep your account password or any means of identification we provide to you that allows access to your account, secure and confidential.
• You will provide us with all evidence that proves your identity according to the discretion of the Al Bassami International Business Company Application.
• You will only use wireless Internet connection devices or the third generation data account (AP) that you are authorized to use.
• When you request the flatbed service via SMS, the usual fees will be applied to these messages.
• The Al Bassami International Business Company Application has the right to refuse to provide the service or use the Application without giving reasons.
• That you will not cancel the service when the driver arrives to perform the service, and that your right to cancel the service is limited to a period of (5) minutes after submitting the request, and that in the event of canceling the service for any reason after the grace period for canceling the request, you will be fined (50) Saudi riyals as a result of the cancellation process.

Scope of the License

Al Bassami International Business Company application grants you a non-exclusive, non-transferable, non-assignable, non-sublicensable and non-revocable license to obtain and use our services only for personal purposes (not for any commercial purposes, for example, but not limited to) in accordance with this contract, so you must:

• Not make the services available or rent, lease, assign, resell, distribute or sublicense these services to any third party.
• Not to modify, excerpt, translate, summarize, create a subset of, decompile, or reverse engineer the design of the Al Bassami International Business Company application or otherwise identify or attempt to identify or attempt to access the source code or internal design of the Services or any text, multimedia images (photos, audio, video files), data or other information provided by the Al Bassami International Business Company application or third party service providers.
• Not to delete, change, or otherwise modify any copyright or other official notices contained in the Services.
• Not to intentionally transfer, distribute, or allow the Services to be downloaded for use other than as specified herein.
• Not to claim to grant or allow access to the Services to anyone other than you.

Intellectual Property Rights

• All intellectual property rights to these Services and all materials related thereto or
• You must not reproduce or allow anyone, for any reason, to use or reproduce the Services or any trademarks or other trade names appearing on the Services.

Prices

• The prices shown in the application for each service are based on the request before the request and the price may vary according to the region, the time of the service request and the availability of service providers within the search scope. For the transportation of vehicles (flatbed), there is a meter that depends on the type of flatbed, the distance and duration of the trip traveled by the vehicle in addition to the time of sending the request.

Payment

• Al Bassami International Business Company application reserves the right to impose new fees for the use of the application or the service or both.

• If Al Bassami International Business Company application decides to impose new fees, you will be informed of this and you will be allowed to continue or terminate the contract.

• The prices applied by the flatbed service providers for providing the service can be found on the website or through the application.

• Al Bassami International Business Company application may amend or update prices from time to time. It is your responsibility to stay informed of the current prices for the flatbed service

• You must pay the value of the flatbed service to the service provider in cash, immediately upon providing the service to you. You are solely responsible for paying all fees on time. You acknowledge that any amount paid is non-refundable.

• You acknowledge and agree that you accept and comply with the value and distance calculated by the Al Bassami International Business Company application meter "the meter", which Al Bassami International Business Company application guarantees its accuracy by 99%, and you agree that the calculated fare and distance traveled are those calculated by the Al Bassami International Business Company application meter for each transfer.

• You acknowledge and agree that in any case and in the event that the Al Bassami International Business Company application meter malfunctions during the transfer process for any reason, whether the reason is due to the Al Bassami International Business Company application technologies, or to your own equipment, you are obligated to pay only the basic fare value to the service provider, which is the amount shown in the application for the type of service requested.

• You acknowledge and agree to always be honest with regard to the value and truth of transactions, opening the meter, etc., and you agree that in the event of discovering any fraud, manipulation, or deception, you will be subject to stopping your services and blocking them from the application of Al Bassami International Business Company, in addition to the right of Al Bassami International Business Company to collect a fraud fine starting from (500) Saudi riyals and reaching (1000) Saudi riyals, in addition to the right of Al Bassami International Business Company to claim compensation for all damages that resulted or will result as a result of this fraud and manipulation.

Compensation

By agreeing to these Terms of Use and using the Application or Service, you agree to defend, hold harmless and indemnify Al Bassami International Business Company, its affiliates, its licensors, and each of their officers, directors, other users, employees, attorneys and agents from any claims, costs, damages, losses, liabilities and expenses (including, without limitation, attorneys' fees and costs) arising out of or relating to:

• Your violation or breach of any of these Terms of Use or any applicable law or regulation, whether or not referred to in these Terms and Conditions of Use.

• Your violation of any rights of third parties, including tow truck service providers regulated by the Application.

• Your use or misuse of the Application or Service.

Legal Liability

• The information, recommendations and services or any of them provided to you on or through the Website, Service and Application are for general information purposes only and do not constitute advice.

• Al Bassami International Business Company will maintain the correctness and update of the website, application and its contents as much as possible, but it does not guarantee that the (contents) of the website or application are free from errors, defects, malware and viruses, nor does it guarantee the correctness, accuracy and update of the website and application.

• Al Bassami International Business Company application shall not be liable for any damages resulting from the use (or inability to use) of the website or application, including damages caused by malware or viruses, nor shall it be liable for the incorrectness or incompleteness of the information or the website or application, unless such damage is the result of intentional misconduct or gross negligence on the part of Al Bassami International Business Company application.

• The responsibility for the quality of the flatbed service requested using the application or service lies entirely with the service provider who ultimately provides you with the flatbed service.

• Al Bassami International Business Company application shall not accept any responsibility under any circumstances related to or arising from the flatbed services provided by the service provider,

• Al Bassami International Business Company application shall not accept responsibility for any acts, actions, behavior or negligence, or all of the above, on the part of the flatbed service provider. Any complaints regarding the flatbed services should be submitted to the service provider.

Modification of Services

Al Bassami International Business Company application reserves the right, at its sole discretion, to do the following at any time:

• Change the services or any related materials; and/or stop publishing its services.

• If Al Bassami International Business Company application decides to stop publishing its services, it may replace the services with other similar materials.

Limitation of Liability

•  Al Bassami International Business Company application does not provide any warranties, express or implied, regarding the services, as they are all provided “as is.” ".

- Al Bassami International Business Company expressly disclaims, to the fullest extent possible under the law, all warranties, including but not limited to, warranties of fitness for a particular purpose, suitability for particular specifications and markets, and merchantability. .

Security

• You acknowledge that you are solely responsible for the privacy of the Services, and you are solely responsible for the use of the Services by any other person using your account and/or username, password, or access credentials.

• You agree to notify Al Bassami International Business Company Application if you become aware of any loss, theft, or unauthorized use of any password, user name, IP address, or other means of accessing the Services.

Duration and termination of the contract

The contract concluded between you and Al Bassami International Business Company application is indefinite. You have the right to terminate the contract at any time by permanently deleting the application installed on your smartphone, and thus Al Bassami International Business Company application has the right to terminate the contract with immediate effect at any time (by disabling your use of the application and the service), in the event that you do any of the following:

• Violation or breach of any of the terms of use,

• If Al Bassami International Business Company application sees that you are misusing the application or the service.

• Al Bassami International Business Company application is not obligated to send prior notice of termination of the contract.

Invalidity of one or more provisions
